Aside from who sued whom, what's interesting is who's playing the accompaniment. This is the B side of Lover Come Back To Me recorded at the same session. On the A side a violin, probably Ben Selvin, is heard but not here. The muted trumpet, on both sides, is most likely Mike Mosiello (or perhaps Tommy Dorsey) and, according to Rust, the low register clarinet is by Andy Sanella who plays the guitar on the A side, again according to Rust. Since at one point both clarinet AND rhythm guitar are heard simultaneously here, obviously two players are involved; either Sanella plays guitar on both tracks and an unknown plays the clarinet, or perhaps more likely in spite of Rust's normally extremely accurate personnel notes, Sanella is the clarinet player and someone else plays the guitar on both tracks, the most likely contender being Eddie Lang. The pianist and bass player on both sides are Rube Bloom and Joe Taro respectively.
and annette and helen were imitating an artist from up in harlem (can't find her name at the moment..sorry.helen tried to sue the artist, but it didn't hold since she predated helen by some years... the voice was all part of the era and was imitated even on the streets by young flappers to appear innocent,cute and coy...baby talk..ha. love this recording as well. what an era and what a singer. thanks for sharing.

Helen didn't sue the black artist, she had no grounds for a suit. She did actually sue the makers of the Betty Boop movies (Fleishman Brothers I believe) who were imitating not only Helen's voice but also her mannerisms and image. As to the voice, the judge ruled that both parties had imitated several black "baby voice" singers who predated them by 20 years and no one could "own" that singing style. As to stealing Helen's image, both the judge and the Fleishmans were Jewish-nuff said?
